AFinnovations Terms and Conditions
1. Introduction and Acceptance
These terms and conditions ("Terms") govern your use of the AFinnovations website ("Website") and the carbon impact tracking and offsetting services ("Services") provided by AFinnovations ("Company," "we," "us," or "our").
By accessing or using the Website or Services, you ("Customer," "you," or "your") agree to be bound by these Terms.
If you do not agree with any part of these Terms, you must not use our Services.
Definitions:
- "Carbon Impact": Refers to the calculated amount of greenhouse gas emissions generated by your gas, electricity, and/or vehicle usage.
- "Offsetting": The process of counteracting your Carbon Impact by supporting projects that reduce or remove an equivalent amount of greenhouse gas emissions, facilitated through our third-party offsetting partner.
2. Use of Services
Eligibility: You must be at least 18 years old to use our Services. If you are using the service for a business, you confirm you have the authority to bind that business.
Account Creation: You must create an account to access our Services. You are responsible for maintaining the confidentiality of your account credentials.
Service Description:
- We will track your Carbon Impact based on data obtained from your smart meter (gas and electricity) via our third-party data provider, N3rgy, and/or vehicle usage data provided by you.
- We will offset your calculated Carbon Impact through a third-party partner who provides verified carbon offset projects, including but not limited to blue carbon initiatives and tree planting.
- You will have access to reports and statistics on your Carbon Impact and offsetting activities through the Website.
N3rgy Terms: Access to your smart meter data is provided through N3rgy. You agree to comply with N3rgy's terms and conditions, wwith consent provide via the signup process. N3rgy's terms and conditions are viewable via your profile.
Data Accuracy: You are responsible for ensuring the accuracy of the data you provide to us, including smart meter access and vehicle usage information.
Service Limitations: We will make commercially reasonable efforts to provide accurate Carbon Impact calculations and offsetting, but we do not guarantee absolute accuracy. Factors outside of our control can impact the accuracy of the data.
3. Orders, Payments, and Pricing
Sign-Up Fee: A non-refundable sign-up fee of £25 is required to cover administrative activities.
Subscription: Our Services are offered on a monthly subscription basis.
Payment: You agree to pay the subscription fees in accordance with the pricing and payment terms specified on the Website. Subscription fees will vary based on selected options, including tracking level, property size, and, if applicable, estimated yearly mileage for car offset.
Payment Method: Payments will be processed via direct debit using GoCardless. You agree to comply with GoCardless's terms and conditions here.
Billing: You will be billed monthly.
Price Changes: We reserve the right to change our subscription fees. We will provide you with reasonable notice of any price changes.
Cancellations: You may cancel your subscription through the Website. Cancellation will take effect at the end of your current billing cycle.
Refunds: The £25 signup fee is non-refundable. Monthly subscription fees are non-refundable once the payment has been processed. Refunds for other issues are handled on a case-by-case basis.
4. Data Collection and Usage
Smart Meter Data: You authorize us, through N3rgy, to access and collect data from your smart meter for the purpose of calculating your Carbon Impact.
Vehicle Usage Data: If you opt for vehicle usage tracking, you agree to provide us with accurate vehicle usage data.
Data Usage: We will use your data to:
- Calculate your Carbon Impact.
- Provide you with reports and statistics.
- Improve our Services.
- Comply with legal obligations.
Data Privacy: We will handle your data in accordance with our Privacy Policy here.
Data Security: We will take reasonable measures to protect your data from unauthorized access or disclosure.
Post-Cancellation Data Access: All statistics and reports generated during your subscription period will be available for you to access through your account on the Website for a period of one (1) year following the date of cancellation.
5. Intellectual Property
The Website and all content, including reports, statistics, and logos, are owned by or licensed to us.
You are granted a limited, non-exclusive, and non-transferable license to access and use the Website and Services for your personal or business use.
You must not reproduce, modify, or distribute any content from the Website without our prior written consent.
6. Disclaimer of Warranties
We provide the Services "as is" and "as available."
We make no warranties, express or implied, regarding the accuracy, reliability, or availability of the Services.
We do not warrant that the Services will be error-free or uninterrupted.
7. Limitation of Liability
We will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services.
Our total liability to you for any damages arising from your use of the Services will not exceed the amount you paid for the Services in the preceding three (3) months.
We are not responsible for any issues arising from your smart meter, or access to your smart meter data, which is provided through N3rgy.
8. Indemnification
You agree to indemnify and hold us harmless from any claims or losses arising from your use of the Services or your breach of these Terms.
9. Termination
We may terminate your access to the Services if you breach these Terms.
You may terminate your subscription as described in Section 3.
Upon termination, you will no longer have access to your account or data, except for the post cancellation data access as described in section 4.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of England and Wales.
Any disputes arising from these Terms will be resolved in the courts of England and Wales.
11. Changes to Terms and Conditions
We may modify these Terms at any time.
We will notify you of any changes by posting the updated Terms on the Website.
Your continued use of the Services after any changes constitutes your acceptance of the new Terms.
